On Thursday morning, September 25, 2008 Marine Lance Corporal Justin Sharratt, age 24, a resident of Canonsburg, Washington County, Pennsylvania, will file a lawsuit in Federal Court in Pittsburgh, Pennsylvania against Congressman John Murtha (D-Pennsylvania).

In March 2006, Murtha drew world-wide attention to an encounter in Haditha, Iraq which occurred in November 2005 wherein 24 Iraqi insurgents were killed. Murtha appeared repeatedly on national television and claimed that Lance Corporal Sharratt and his fellow Marines "committed cold-blooded murder" of innocent women and children. Murtha further claimed that the Haditha encounter "was worse" than the infamous My Lai massacre of Vietnam.

Murtha's statements and the alleged incident dominated the national news for close to a year.

Lance Corporal Sharratt was charged with three counts of unpremeditated murder in Military Court but was exonerated after a full investigation and an Article 32 Hearing.

Murtha's statements were false and recklessly made. Unfortunately for the young Marine, Murtha's false, reckless statements were published and republished repeatedly throughout the world.

The federal lawsuit alleges that Murtha stripped Sharratt of his constitutional right to the presumption of innocence as well as Sharratt's constitutional right to due process of law. Sharratt is also suing Murtha for slander.

Murtha, who is running for re-election, just released a campaign brochure which claims: "Honoring our Troops is a Top Priority for John Murtha".

A press Conference will be held at 1:30 p.m. on Thursday, September 25, 2008 in Attorney Geary's Pittsburgh Office for Local and National Media.
